Stalking in Alabama is a serious felony offense which typically arises out of a prior romantic relationship, or desired romantic relationship. Stalking first is a Class C felony, punishable by a year and a day to 10 years in prison, however, if you are charged with aggravated stalking I is guilty of a Class B felony punishable by 2 to 20 years in prison. Aggravated stalking in the first degree simply means stalking first while you are under an order of protection or injunction from the court advising you to stay away from the alleged victim
Stalking II (Stalking 2nd) applies to someone who repeatedly follows or harasses another person and causes them mental or emotional harm. No threats or actual danger is necessary for someone to be convicted of stalking in the second degree. Alabama Code 13A-6-90.1 covers the charges of stalking 2nd. Stalking second is a Class B misdemeanor, punishable by up to 6 months in the county jail, unless you are charged with aggravated stalking second. Aggravated stalking in the second degree is a Class C felony, punishable by up to 10 years in prison, and applies to someone who commits the crime of stalking II while under an injunction or order of protection against the victim.
